Sand Removal Permit
Guidelines for Application of Sand Removal Permit

Statutory Requirements

Under the Sand Ordinance (Cap. 147), a Sand Removal Permit is required from the Director of Civil Engineering and Development for the removal, transportation or importation of sand in Hong Kong. The Ordinance does not apply to sand produced by any quarrying operation or by the washing of other material so as to produce sand.


Who are eligible to apply for a Sand Removal Permit

Only the Importer or the Buyer is eligible to submit the application.


Where to apply for a Sand Removal Permit

Applications should be made to the Chief Engineer/Fill Management of Civil Engineering and Development Department (hereinafter called the CE/FM), at 5/F., Civil Engineering and Development Building, 101 Princess Margaret Road, Homantin, Kowloon.


Methods of Submitting Application

The following methods are available:

  1. in person
  2. by post
  3. by fax (fax no. (852) 27149481)
  4. by email (email address: sandpermit@cedd.gov.hk). Applicant shall prepare the application in accordance with the Submission of Electronic Information under Law by Virtue of the Electronic transactions Ordinance. Supporting documents must be produced when collecting the Natural Sand Final User Certificate or the Sand Removal Permit.

Application forms can be downloaded from the website of the Civil Engineering and Development Department ( www.cedd.gov.hk/eng/forms/fm/index.html).

Pre-requisite Requirements before Applying for a Sand Removal Permit

(A) For importing natural sand from Mainland

The Exporter shall apply for the “Export Licence of the People’s Republic of China for natural sand” from the relevant Mainland Authority in prior. Under normal circumstance, the Mainland Authority requires the applicant to produce a valid “Hong Kong Natural Sand Final User Certificate” issued by the CE/FM and also the signed “Letter of Commitment”.

Application for the “Hong Kong Natural Sand Final User Certificate” is described below: -
(Normally takes 2 working days)

Step 1
The application form is available at the Fill Management Division of Civil Engineering and Development Department or download the Final User Certificate Application Form Download PDF (689KB)

Step 2
The Applicant, Final Users and all parties between them must individually sign and return a Letter of Commitment Download PDF (94KB) to the CE/FM committing not to re-export natural sand imported from the Mainland.

Step 3
Before filling the application form, the Applicant should have read and understood the Conditions of “Hong Kong Natural Sand Final User Certificate” and undertake to abide by the requirements under the said Conditions. Step 4
The Applicant shall submit the application form and the duly signed Letter of Commitment(s) together with copies of the following supporting documents to the CE/FM: -

  1. Contract Agreement between the Importer and the Exporter;
  2. Contract Agreement between the Importer and the Final Users requiring the sand; and
  3. Documentary proof of the Project Title and the Construction Project/Contract Number (for the sand used in construction project).

If all the above required information/documents are complete and valid, the CE/FM will issue the “Hong Kong Natural Sand Final User Certificate” to the Applicant. In general, it takes two working days.


(B) For importing natural sand not from Mainland

The Exporter must obtain a valid export licence from the exporting country.


Apply for a Sand Removal Permit
(Normally takes 2 working days)

Step 1
The application form is available at the Fill Management Division of Civil Engineering and Development Department or download the Sand Removal Permit Application Form Download PDF (269KB).

Step 2
If the sand is imported sand, the Applicant should have either of the following export licence: -


(a) For sand imported from the Mainland

“Export Licence of the People’s Republic of China for Natural Sand” from the Mainland Authority.


(b) For sand imported from other countries

“Export Licence” from the exporting country.

Step 3
Before filling the application form, the Applicant should have read and understood the Conditions of “Sand Removal Permit” and undertake to abide by the requirements under the said Conditions. Step 4
The Applicant shall submit a duly completed application form together with the following supporting documents to the CE/FM: -


(a) For importing natural sand from Mainland
  1. Notice of Direction (Sand Barge Route) from the Director of Marine (only for Mainland non-convention vessels);
  2. “Hong Kong Natural Sand Final User Certificate” issued by the CE/FM; and
  3. “Export Licence of the People’s Republic of China for Natural Sand”.

(b) For importing natural sand not from Mainland
  1. Contract agreement between the importer and the exporter; and
  2. Export Licence from the exporting country.

If all the above required information/documents are complete and valid, the CE/FM will issue the Sand Removal Permit to the Applicant. In general, it takes two working days.

Notes

  1. Natural Sand Final User Certificate and Sand Removal Permit are available free of charge.

  2. Both “Hong Kong Natural Sand Final User Certificate” and “Sand Removal Permit” are valid for the maximum 30 days.

  3. Applicants can submit more than one application form at each time of application. Nevertheless, the number of Permits and their total sand quantities shall commensurate with the sand quantities as specified in the Natural Sand Final User Certificate.

  4. The Permittee shall observe and follow the Conditions of “Hong Kong Natural Sand Final User Certificate” and “Sand Removal Permit”. In case of contravention of any of these Conditions, the CE/FM shall have the sole discretion of canceling the Permit without any prior notice.

  5. In accordance with the Conditions of “Hong Kong Natural Sand Final User Certificate” and Conditions of “Sand Removal Permit”, the Certificate holder, Permittee and his Final User(s) should undertake to complete the reporting procedures for the sand imported from the Mainland.   6. Any person who contravenes the Sand Ordinance shall be guilty of an offence and shall be liable on summary conviction to a fine of $2,500 and to imprisonment for 6 months. The sand imported will also be seized.
